We collect information you provide when you create an account, build a profile, list items, communicate with other users, or make or receive payments. This includes:

  • Identity information: Full name, date of birth, and government-issued ID (collected through Stripe identity verification)
  • Contact information: Email address, phone number, and postal address
  • Business information: Business name, EIN or Tax ID, and business address (required for Pro and Enterprise users)
  • Payment information: Bank account details, payment card information, and payout preferences (processed and stored securely by Stripe — CYS does not store raw payment card data)
  • Listing information: Photos, descriptions, condition, pricing, pickup location, and any other content you submit
  • Communications: Messages sent through our internal messaging system between buyers and sellers

1.2 Information We Collect Automatically

When you access or use our Service, we automatically collect certain information, including:

  • Device and usage data: IP address, browser type and version, operating system, device identifiers, and referring URLs
  • Log data: Pages visited, time spent on pages, links clicked, search queries, and other actions taken on the platform
  • Location data: General geographic location derived from your IP address; precise location only if you grant permission (e.g., for geotag check-in during pickup confirmation)
  • Transaction data: Order history, transaction amounts, Release Code activity, pickup confirmations, and dispute records

1.3 Information From Third Parties

We may receive information about you from third parties, including:

  • Stripe: Identity verification results, payment processing data, fraud signals, and KYC (Know Your Customer) information
  • Social media platforms: If you choose to connect a social account or sign in via a third-party provider
  • Public sources: Publicly available business records used to verify seller information in accordance with the INFORM Consumers Act

2. How We Use Your Information

We use the information we collect for the following purposes:

2.1 Providing and Operating the Service

  • Creating and managing your account
  • Processing transactions and facilitating payments through Stripe Connect
  • Generating and managing Release Codes and escrow activity
  • Enabling communication between buyers and sellers through our internal messaging system
  • Displaying listings and facilitating pickup coordination

2.2 Safety, Trust, and Fraud Prevention

  • Verifying user identities through Stripe to maintain a trusted community
  • Detecting, investigating, and preventing fraudulent transactions, scams, and policy violations
  • Monitoring for prohibited items, off-platform communication attempts, and other Terms of Service violations
  • Cooperating with law enforcement when required by law or in response to valid legal process

2.3 Legal Compliance

  • Complying with the INFORM Consumers Act, including collecting, verifying, and disclosing high-volume seller information as required
  • Issuing or facilitating 1099-K tax reporting through Stripe for sellers who meet IRS thresholds
  • Complying with applicable state marketplace facilitator tax laws
  • Responding to lawful requests from courts, law enforcement, and regulatory authorities

2.4 Communications

  • Sending transaction confirmations, receipts, and order updates
  • Notifying you of account activity, security alerts, and policy changes
  • Sending promotional communications about new features, listings of interest, and platform updates (you may opt out at any time)

2.5 Platform Improvement

  • Analyzing usage trends and platform performance
  • Conducting research and developing new features
  • Personalizing your experience, including surfacing relevant listings and search results

3. Cookies and Tracking Technologies

We use cookies, web beacons, pixels, and similar tracking technologies to operate and improve the Service.

3.1 Types of Cookies We Use

  • Essential cookies: Required for the platform to function, including session management, authentication, and security
  • Analytics cookies: Help us understand how users interact with the platform (e.g., pages visited, time on site, search behavior)

4.1 With Other Users

To facilitate transactions, certain information is shared between buyers and sellers:

  • Your public profile, listings, and seller ratings are visible to all users
  • When a transaction is initiated, we share necessary details with the other party, such as pickup location and verified identity status
  • Pickup addresses are only revealed after a transaction is confirmed and payment is secured in escrow
  • High-volume sellers may have their name, address, and contact information disclosed to buyers as required by the INFORM Consumers Act

4.2 With Service Providers

We share information with trusted third-party vendors who help us operate the platform, including:

  • Stripe: Payment processing, identity verification, escrow management, and 1099 tax reporting
  • Cloud and hosting providers: Secure data storage and infrastructure
  • Analytics providers: Platform performance and usage analysis
  • Email and SMS providers: Transactional and promotional communications

All service providers are contractually required to protect your information and use it only for the purposes for which it was shared.

4.3 For Legal and Safety Reasons

We may disclose your information if we believe in good faith that disclosure is necessary to:

  • Comply with applicable laws, regulations, or legal process
  • Enforce our Terms of Service or other agreements
  • Protect the rights, property, or safety of CYS, our users, or the public
  • Detect, prevent, or address fraud, security, or technical issues
  • Respond to lawful requests from law enforcement or government authorities

4.4 Business Transfers

In the event of a merger, acquisition, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on the Service prior to your information being transferred and becoming subject to a different privacy policy.

We may share your information for other purposes with your explicit consent.


5. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you the Service. Specifically:

  • Account data is retained for the life of your account and for a reasonable period after account closure to resolve disputes, enforce agreements, and comply with legal obligations
  • Transaction records are retained for a minimum of 7 years to comply with tax and financial recordkeeping requirements
  • Identity verification data is retained as required by Stripe's policies and applicable law, including INFORM Act requirements
  • Communications sent through the platform's messaging system are retained to support dispute resolution
  • You may request deletion of your personal data at any time (see Section 7), subject to our legal retention obligations

6. Data Security

We take the security of your personal information seriously and implement reasonable administrative, technical, and physical safeguards to protect it from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. These measures include:

  • SSL/TLS encryption for data in transit
  • Secure storage of all personal data with access controls
  • Payment data processed exclusively through Stripe — CYS does not store raw card numbers or banking credentials
  • Identity verification handled by Stripe's secure, regulated infrastructure
  • Regular review of our data collection, storage, and processing practices

7. Your Privacy Rights

Depending on your location, you may have certain rights regarding your personal information. These may include the right to:

  • Access: Confirm whether we process your personal data and request a copy of it
  • Correction: Request correction of inaccurate or incomplete personal data
  • Deletion: Request deletion of personal data we hold about you, subject to legal retention obligations
  • Portability: Obtain a copy of your personal data in a portable, machine-readable format where technically feasible

We may need to verify your identity before processing your request. We will not fulfill requests that would require us to violate applicable law or our legal obligations.

If you are a resident of California, Connecticut, Virginia, Colorado, or another state with applicable consumer privacy laws, you may have additional rights under those laws. The Service is intended for users who are 18 years of age or older. We do not knowingly collect personal information from anyone under the age of 18. If we become aware that we have collected personal information from a minor, we will take steps to delete it promptly. 9. Third-Party Links and Services

Our Service may contain links to third-party websites, services, or applications that are not operated by us. This Privacy Policy does not apply to those third-party services. 10. INFORM Consumers Act and Seller Disclosure

As described in our Terms of Service, we comply with the INFORM Consumers Act. Information collected from high-volume sellers under this law — including bank account information, tax ID, and contact details — is:

  • Collected and verified solely for the purpose of INFORM Act compliance
  • Protected with reasonable security procedures and practices
  • Not used for any other purpose unless required by law
  • Retained for the period required by applicable law

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will notify you by email or by posting a prominent notice on the Service at least 30 days before the changes take effect. We encourage you to review this policy periodically. Your continued use of the Service after any changes constitutes your acceptance of the updated policy.
